A parent or legal guardian must complete the required consent process for a participant who is a minor, where applicable.
-
Registration is considered confirmed only after the required registration process has been completed and payment has been successfully verified.
-
APEX reserves the right to verify registration details and request supporting documents where reasonably necessary.
-
Providing false information, impersonating another participant, or submitting fraudulent documents may result in cancellation of registration.
-
Registration is personal to the registered participant and cannot be transferred to another person without prior written approval from APEX.
3. Registration Fees and Payments
-
Registration fees are displayed on the applicable event or service registration page.
-
Participants must pay the applicable fee through the payment methods provided during registration.
-
Registration is subject to successful payment verification and confirmation.
-
Any applicable taxes, payment processing charges, or other fees will be disclosed as required by law.
-
Participants are responsible for ensuring that their payment details and registration information are correct.
-
If a payment is deducted but registration is not confirmed, participants should contact APEX with the relevant transaction reference.
-
APEX will investigate payment discrepancies and process any confirmed duplicate or erroneous payment refunds in accordance with applicable law and the payment provider's procedures.
4. Cancellation, Refunds, and Deferrals
A. General Refund Policy
Except where a refund is required by applicable law or expressly approved under a written policy applicable to the particular service, registration fees are non-refundable once registration has been completed and confirmed.
This policy applies to APEX events, virtual challenges, swimathons, running events, training camps, coaching programs, and other paid services, subject to any specific contractual terms applicable to a particular service.
B. Participant-Initiated Cancellation
If a participant voluntarily withdraws, fails to attend, arrives late, or is unable to participate for personal, professional, travel, health, or other individual reasons, no refund will ordinarily be provided, subject to applicable law.
C. Deferral to Another APEX Event
APEX may, at its discretion and subject to availability, approve a deferral to another APEX event or program.
-
Deferrals require prior written approval from APEX.
-
Deferrals are not automatic and are subject to eligibility, availability, and any applicable conditions communicated by APEX.
-
The replacement event may have different fees, eligibility requirements, dates, or formats.
-
A participant may be required to pay any applicable fee difference.
-
A deferral cannot be sold, exchanged for cash, or transferred to another participant without written approval.
-
APEX may specify a deadline by which the deferral must be requested and used.
D. Event Cancellation or Major Changes
If APEX cancels an event, materially changes its format, or is unable to provide the registered service, APEX will communicate the available options and handle refunds, credits, or deferrals in accordance with applicable law and the terms applicable to that event.
Nothing in this policy excludes or limits any refund or other right that cannot legally be excluded.
5. Event Schedule, Venue, and Changes
-
Event dates, venues, distances, start times, routes, and schedules will be communicated through official APEX channels.
-
APEX may make reasonable changes to the venue, route, schedule, format, or operational arrangements for safety, weather, environmental, logistical, regulatory, or other legitimate reasons.
-
Participants are responsible for checking official event communications before travelling to the venue.
-
If a material change or cancellation occurs, APEX will communicate the relevant information and applicable options in accordance with these terms and applicable law.
-
APEX does not guarantee that every advertised feature, partner, or activity will remain available if circumstances beyond its reasonable control require changes.
6. Participant Health and Fitness
-
Participants are responsible for ensuring that they are physically capable of undertaking their selected sporting activity.
-
Participants should seek appropriate medical advice before participating if they have a medical condition, injury, or other concern that could affect safe participation.
-
Participants must follow event instructions, safety briefings, route directions, and instructions issued by authorized officials.
-
Participants must stop their activity and seek assistance if they experience concerning symptoms, significant pain, dizziness, unusual breathlessness, or other signs that continuing may be unsafe.

APEX may refuse participation, withdraw a participant from an activity, or recommend medical assessment where there are reasonable safety concerns.
-
Participants must not participate while impaired by alcohol, recreational drugs, or any substance that could compromise their safety or the safety of others.
7. Assumption of Sporting Risks and Liability
Running, swimming, cycling, triathlon, strength training, and other endurance activities involve inherent risks, including falls, collisions, exhaustion, dehydration, adverse weather, water-related incidents, serious injury, and death.
By participating, participants acknowledge these inherent risks and agree to follow the applicable safety requirements.
APEX will take reasonable measures appropriate to the event and its responsibilities to support participant safety. However, no safety arrangements can eliminate every risk.
Nothing in these terms excludes or limits liability for fraud, wilful misconduct, negligence where such liability cannot legally be excluded, death or personal injury to the extent exclusion is prohibited by law, or any other liability that cannot lawfully be limited.
Participants remain responsible for their own conduct, preparation, equipment, and compliance with safety instructions.

-
Participants must use suitable swimming equipment and disclose relevant information required for event safety.
-
Participants must comply with all additional event-specific rules communicated before or during the event.
Failure to comply with mandatory safety instructions may result in disqualification or removal from the activity without a refund, subject to applicable law.

-
APEX may request supporting activity links, screenshots, or additional evidence to verify participation.
-
Activities that cannot be verified or that violate the published rules may be excluded from results.
-
Participants are responsible for the accuracy of their activity records and the settings of their tracking devices and third-party accounts.
-
APEX is not responsible for interruptions, device failures, GPS inaccuracies, platform outages, or data loss caused by third-party services. Verification issues will be reviewed under the applicable challenge rules.

-
Participants may be asked to provide supporting evidence within a specified time.
-
APEX will address result disputes through the official contact channel and may establish a deadline for submitting objections.
-
APEX's decisions will be made in accordance with the published event rules, applicable law, and any required review process.
11. Prizes, Awards, and Certificates
-
Prizes, medals, certificates, merchandise, and other benefits are subject to the eligibility criteria and conditions published for the relevant event.
-
Winners must satisfy all verification and eligibility requirements before a prize is awarded.
-
APEX may request identification or other reasonable documentation to confirm a winner's identity and eligibility.
-
Prizes are not transferable or exchangeable for cash unless expressly stated otherwise or required by law.
-
Where a prize involves silver, precious metals, or another valuable item, its description, weight, purity, form, and applicable conditions will be governed by the official event announcement.
-
Any stated prize weight refers to the specification expressly advertised for that prize; the actual form, certification, and delivery arrangements will be communicated by APEX.
-
APEX may withhold or reassign a prize where the selected winner is ineligible, cannot be verified, or has materially breached the applicable rules, subject to applicable law.
-
Certificates and finisher awards are issued only to participants who meet the published completion and verification criteria.
12. Coaching Programs and Training Services

Coaching plans are based on the information supplied by the athlete and the scope of the selected coaching package.
-
Athletes must provide accurate information about training history, current fitness, injuries, availability, and relevant medical restrictions.
-
Training recommendations are intended to support athletic development and are not a substitute for diagnosis or treatment by a qualified healthcare professional.
-
Athletes are responsible for following plans sensibly, reporting significant symptoms or injuries, and seeking professional medical advice when appropriate.
-
Results vary according to individual factors, including consistency, recovery, nutrition, health, training history, and external circumstances. APEX does not guarantee a particular performance result, qualification, finishing time, or race outcome.
-
Package inclusions, communication frequency, duration, race support, merchandise, and other deliverables are as stated in the applicable coaching agreement or package description.
-
Fees, cancellations, pauses, and deferrals for coaching services are subject to the specific coaching agreement and applicable law.

Cheating, impersonation, or falsification of records.
-
Ignoring safety instructions or restricted-area rules.

Conduct that creates an unreasonable risk to others.
APEX may issue a warning, remove a participant from an activity, or disqualify a participant where warranted by the seriousness of the conduct and the applicable rules. Any refund or fee consequences will be handled in accordance with the applicable policy and law.
14. Photography, Video, and Publicity
APEX events may be photographed or recorded for documentation, event reporting, and promotional purposes.
The use of identifiable participant images for promotional purposes will be handled in accordance with the applicable privacy policy, relevant consent requirements, and applicable law.
Participants should review any separate media consent presented during registration. Refusing optional promotional consent should not be treated as consent to publicity.
15. Intellectual Property
All APEX logos, branding, website content, designs, photographs owned by APEX, event materials, training resources, and other original content are protected by applicable intellectual property laws.
No person may copy, reproduce, distribute, modify, commercially exploit, or use these materials without prior written permission from the relevant rights holder, except where permitted by law.
Athletes may not represent themselves as official APEX representatives or use APEX branding in a misleading manner without authorization.
16. Website Use and Accuracy
Users must not misuse the website, attempt unauthorized access, interfere with its operation, upload malicious content, or use it for unlawful purposes.
We make reasonable efforts to maintain accurate website information. However, descriptions, schedules, images, and other content may change. Official event communications and applicable registration terms should be consulted for the current details of a particular event.
Nothing in this clause removes any consumer rights or other protections available under applicable law.
17. Third-Party Services
APEX may use third-party services for registration, payments, communication, activity tracking, timing, or event management.
Use of these services may be subject to separate terms and privacy policies. APEX is not responsible for independent third-party acts or outages beyond its reasonable control, without limiting any responsibility imposed on APEX by law.
18. Force Majeure and Unforeseen Circumstances
Events may be affected by circumstances outside APEX's reasonable control, including extreme weather, natural disasters, public-health emergencies, government restrictions, venue unavailability, civil disturbances, transport disruption, or other serious operational or safety issues.
APEX may take reasonable steps to postpone, modify, relocate, suspend, or cancel an affected event.
Where such circumstances arise, APEX will communicate relevant changes and available remedies in accordance with the event-specific terms and applicable law. This clause does not automatically eliminate any refund or other obligation that the law requires.
19. Privacy and Personal Information
Personal information collected during registration and participation is handled in accordance with the APEX Privacy Policy published on our website.
By registering, participants acknowledge that relevant personal information may be processed for registration, payment verification, event administration, safety, results, certificates, prize verification, and other purposes explained in that policy.
Any consent required for optional marketing, promotional photography, or other optional processing will be handled separately where required by law.

The latest version will be published on the official website with an updated effective date. Material changes affecting an existing registration will be communicated where required by law.
